Enduser Agreement

Welcome to use Fit Monster and relevant services of Chuan OptoElectronics Limited (“Chuan” “we,” “us,” or “our”). You must read and comply with the Enduser Agreement and Privacy Policy to use Fit Monster. Your use and other similar acts shall be deemed that you have read and agreed to be bound by the Agreement. These Terms and Conditions are a binding legal agreement, please carefully read and fully understand the content of each term, in particular the terms with respect to exemption or limitation of liability. 1. Acceptance Of The Agreement

Your use and other similar acts shall be deemed that you have read and agreed to be bound by the Agreement.

2. Updates to this Agreement

We may revise or otherwise change or update this Agreement. Changes will become effective immediately after they are posted. We encourage you to periodically review this Agreement to see if there have been any changes that may affect you. If you do not agree to this Agreement as modified, then you must discontinue your use of the App. Your continued use of the App will signify your continued agreement to this Agreement as it may be revised from time to time.

3. Protection of the User’s Personal Information

It is a fundamental principle of Chuan to protect the user’s personal information. We take your privacy very seriously. We will take reasonable measures to protect your personal information. Except for the circumstances prescribed by laws and regulations, we will not disclose personal information to third parties without user permission. The APP adopts professional encryption storage and transmission method for relevant information to ensure the security of users' personal information.

4. Intellectual Property Rights

You may not reproduce, modify, create derivative works from, display, frame, perform, publish, distribute, disseminate, transmit, broadcast, or circulate any such materials or content to any third party (including displaying or distributing the material using a third-party website) without Chuan’s prior written consent, except to use the Services for their intended purposes. Chuan retains all rights that are not otherwise expressly granted in these Terms.

 

Privacy Policy

Welcome to use Fit Monster and relevant services of Chuan OptoElectronics Limited (“Chuan” “we,” “us,” or “our”). We know that our users (“you,” “your,” or “yourself”) care about how your personal information is used and shared, and we take your privacy seriously. Please read the following to learn more about our Privacy Policy. Your use and other similar acts shall be deemed that you agree to the practices and policies set forth in this Privacy Policy.

We respect and protect the personal privacy of all service users. In order to provide a quality and secure service, we use your personal information according to the terms of the Privacy Policy in effect at the time of our use. We may amend this Privacy Policy from time to time. If you agreed to be bound by the Enduser Agreement, you will be deemed that you have read and agreed to be bound by this Privacy Policy.

1. Collection of Information

We collect non-personal information from users. Non-personal information is information that is about you but individually does not identify you, such as information about your internet connection, the equipment you use to access our App, and usage details.

2. Use of Information

We will not actively share, rent, sell or transfer your personal information to any third party outside of Chuan.

3. Disclosure of Information

In accordance with relevant laws and regulations and national standards, we may publicly disclose personal information without prior consent of the personal information subject under the following circumstances:

a) When it relates to our obligations pursuant to any relevant laws and regulations;

b) When it is directly related to national security or national defense;

c) When it is directly related to public safety, public health, or major public interests;

d) When it is directly related to a criminal investigation, prosecution, trial or execution of judgments;

e) When it is for protecting vital legitimate interests of you or of other individuals, such as right of life, property, and reputation, while it’s difficult to obtain the consent of the individual;

f) When the personal information is disclosed to the public by yourself;

g) When the personal information is collected from legally publicly disclosed information, such as legitimate news reports, government information disclosure, etc.

4. Storage, Retention and Deletion of User Data

4.1 Data Retention Period

We only retain your personal and user data for the duration of your active use of the Fit Monster App. We do not retain any user data indefinitely, nor implement delayed data deletion mechanisms. All user data will not be stored persistently after the user terminates the account or stops using the App.

4.2 User Data Deletion Rules & Methods

Fit Monster fully supports independent user data management and complete data erasure, adhering to Google Play user data safety regulations. We provide clear, effective and thorough in-app data deletion functions with no delayed deletion, no data reservation, no residual backup, and no retained user data after deletion. All deletion operations take effect immediately and completely, and we will not retain any of your personal data or usage data without exception.

1. Server & Cloud Data Complete Deletion: When you log out and cancel your account in the Fit Monster App, all your account-related data stored on our official servers and cloud platform will be completely, permanently and irreversibly cleared. This includes all your personal identity information, usage records, behavioral data, configuration data and all other associated account data. Once the account logout operation is completed, no relevant user data will be reserved, backed up or retained on our server side in any form.

2. Local Device Data Complete Deletion: All local cache data, offline usage data and local configuration data generated by the Fit Monster App on your personal mobile device will be completely erased automatically after you re-login to your account. After re-login, all previous local data will be fully cleared and cannot be recovered, ensuring no residual user data remains on your device.

Users can complete all account logout and data deletion operations independently through the native built-in function inside the Fit Monster App. The whole process is autonomous, immediate and effective without any waiting period, manual review or additional operation steps. We strictly implement the full data clearing mechanism as described above to fully protect users' data privacy rights and meet standardized privacy compliance requirements.

4.3 Data Storage Location

We will act in accordance with laws and regulations and store collected personal information within the territory of China. We will strictly abide by relevant laws and regulations if your personal information needs to be transferred from a Chinese mainland storage location to an overseas storage location.

5. Changes To Our Privacy Policy

If we decide to change our privacy policy, we will post those changes on this page. We encourage you to periodically check back and review this policy so that you always will know our current privacy practices. We reserve the final interpretation right of the above terms.
